‘Sandy Hess, Swords Creek questioned the legality of the ordinance pertaining to the employee bonus’ approved at the May 02, 2022 board meeting.

Alex Bartley, Castlewood commented on the difficulty she was having with the Clinch River Little League’s president concerning the use of the fields.

Lynn Hess, Swords Creek commented that the agenda was not on the website until the afternoon, he also wanted to know the (3) three-minute limit for citizens comment could be changed to (4) four minutes.

Craig Boyd, Vansant stated that he also has had experienced problems with the Clinch River Little League’s president.

The Chair closed citizens comment period.

County Attorney Requests and Reports

Katie Patton, County Attorney asked the board to consider approving the deed with Contura Energy after making a minor change.

APPROVAL OF A LAND DEED OF GIFT – DANTE TRAIL PARKING FROM CONTURA ENERGY

Motion made by Rebecca Dye, second Oris Christian and duly approved by the Board of Supervisors to approve a Land Deed of Gift – Dante Trail Parking from Contura Energy.

At its meeting on May 26, 2022, the Executive Committee utilized Section 15.2-5502 of the Code of Virginia, Wherein that code section states that if an appointed board member has missed any 3 consecutive meetings, or four meetings in a 12-month period, they may be removed from office by the Board of Directors. Our by-laws permit the Executive Committee to act on behalf of the full board when a quorum is not available or when business needs transacted.

Mrs. Victoria Gent was appointed by the Russell County Board of Supervisors in September, 2020, after the Board (RCBOS) removed from office her predecessor (Angela Carpenter). She was to fill Ms. Carpenter’s unexpired term, which ended December 31, 2020. Mrs. Gent was reappointed by the RCBOS to a term that expires December 31, 2022. Since that initial appointment, Mrs. Gent has only attended one meeting (October 2020), although two meetings in 2021 were excused by the Executive Committee. It is the request of the Heart of Appalachia Board of Directors that the RCBOS appoint an individual from the tourism industry to fill the unexpired term of Mrs. Gent.

Once appointed, your chosen individual will need to be sworn in by the Circuit Court Clerk of Russell County, and file with the clerk of the Russell County Board of Supervisors an economic interest disclosure form (these have to be done by all board members of HOA with their own clerks on an annual basis).

Whereas Victoria Gent (Mrs. Gent) was appointed to the Heart of Appalachia Board of Directors (HOA) by the Russell County Board of Supervisors; and

Whereas Mrs, Gent advised HOA that she would be sworn in the last week of September 2020; and Whereas Mrs. Gent has attended only the October 2020 meeting of HOA since being sworn in; and

Whereas Mrs. Gent requested to be excused from four months of meetings in March 2021, which was granted by the Executive Committee; and

Whereas §15.2-5502 of the Code of Virginia permits the HOA Board of Directors remove any member who has missed any three consecutive meetings or four meetings in a 12-month period; and

Whereas the Russell County Administrator and Chairperson of the Board of Supervisors have been consulted about this dispositio Be it therefore resolved that the HOA Board of Directors remove Mrs. Gent from its membership; and

Be it further resolved that the Chairman of the HOA Board of Directors formally request the Russell County Board of Supervisors appoint an individual from the tourism industry to fulfill the remainder of Mrs. Gent’s unexpired term.

The Bristol Transportation District Regional Improvement Commission met at the Southwest Virginia Cultural Heritage Center in Abingdon, Va., Monday, May 23, 2022 at 1:30 p.m. on publicly-advertised call of the first appointed member, Matthew C. Hankins.

Mr. Hankins welcomed the members present and detailed the governing Code Section and some of the issues facing the Commission. As senior commissioner, Mr. Hankins called for nominations for temporary chair. Mr. Lester nominated Mr. Berry as host locality. Mr. Young nominated Mr. Hankins. Mr. Hankins deferred to Mr. Berry, and Mr. Berry was elected unanimously as temporary chair on voice vote.

Mr. Berry called for nominations for temporary recording secretary. Mr. Lester nominated Mr. Hankins, seconded by Mr. Young. Mr. Hankins was elected unanimously as temporary secretary on voice vote.

Mr. Berry moved to the next business item, discussion of bylaws. Mr. Hankins presented a draft set of by-laws based on the Mt. Rogers Cigarette Tax Board. Ms. Mullins suggested holding off on approving by-laws until the Commission is fully constituted, as two localities are not yet represented. The Commission agreed to vote to adopt by-laws at a later meeting, with discussion at this meeting to shape the form of the by-laws.

Mr. Hankins told the Commissioners the only proposed change submitted prior to the meeting was a request from Mr. Young to add a second vice-president. Each planning district commission shall be represented as either president, first vice president or second vice president, with the presidency rotating annually so each Planning District

Commissioners discussed meeting frequency. The general consensus is to meet quarterly in central locations, generally between Abingdon and Lebanon, to keep the longest commissioner drives to roughly one-and-a-half hours. The Commission asks that the host county provide legal counsel for the meeting.

The Commissioners present further discussed changes to the draft by-laws including adding a purpose statement, the last portion of the State Code section creating the Commission. Mr. Young made the motion to add the purpose statement, with a second from Ms. Mullins. The Commission unanimously agreed to the motion.

The Commission discussed scheduling and a remote attendance policy. The Commission will decide after further discussion at its next meeting whether to meet biannually or quarterly. Ms. Mullins suggested the Commission allow remote attendance consistent with Virginia Freedom of Information Act (subject to the prior approval of the chair), that each locality be asked to appoint an alternate to attend and vote on its behalf in the absence of its appointee, and that no proxy votes be permitted. The board consensus favored those motions. Ms. Mullins asked that all counties provide the Commision secretary with written confirmation of its appointments.

The commission discussed the division of funds, whether funds should be divided equally between the 14 localities or by population. After discussion, the general consensus of the Board is an equal 14-way split pending further conversation with legislators about their legislative intent.

Commissioners generally agreed that localities should have flexibility in submitting spending priorities that comply with the statutory requirements. Most members arrived at consensus that they would prefer to designate their funding for EMS and fire department services, while others want to be able to use if for courthouse construction or renovation debt services or for VDOT revenue sharing transportation projects. The Commissioners agreed that localities may choose to use their entire allotment for a single purpose (ie, EMS or debt service), not requiring a set minimum spending percentage for any priority.

The commission will ask the Lottery, casino representatives and legislators to attend the next meeting in Lebanon to clarify outstanding issues and provide the Commission with more clarity on how to proceed.

Outstanding issues include: Fiscal agency: will the lottery distribute to localities directly if asked by the Commission, or will the Commission need a fiscal agent?
How often will payments be distributed by the Lottery?
Will the Commission be able to use portions of the funds for its operations (meeting expenses, audit, banking expenses, etc.)?

Whereas, Spinal Muscular Atrophy is the number one genetic cause of death for infants under two; and

Whereas, Spinal Muscular Atrophy affects approximately one in 11,000 babies, regardless of race, ethnicity, or gender, and one in 50 Americans is a genetic carrier of the disease; and

Whereas, Spinal Muscular Atrophy robs people of physical strength by damaging the motor nerve cells in the spinal cord, taking away the ability to perform basic functions of life, including breathing and swallowing; and

Whereas, there are now FDA-approved treatments for Spinal Muscular Atrophy, all of which need to be administered as soon as possible to be most effective; and

Whereas, screening newborns for Spinal Muscular Atrophy is key to preventing detrimental effects of the condition; and

Whereas, while these treatments and screenings are a breakthrough, there is a pressing need for continued research to meet the changing needs of the entire SMA patient population, especial during this time of pandemic, and to find a cure; then

WHEREAS, Virginia Smart Scale established a prioritization and scoring process to evaluate projects for funding and project selection by the Commonwealth Transportation Board; and

WHEREAS, the Russell County Board of Supervisors hereby strongly supports this RESOLUTION OF SUPPORT for the Dante Steam Building Revitalization Project through the Department of Housing and Community Development (DHCD) Industrial Revitalization Fund (IRF).

WHEREAS, the Dante Community Revitalization Master Plan was created through a partnership with the Dante Community Association, Russell County, and the Virginia Tech Community Design Assistance Center and many other local and regional partners. The plan identified multiple community assets in Dante that are prime for redevelopment for beneficial reuse, including the Steam Building, Depot, Arty Lee School, Trails (both motorized and non-motorized) and Museum.

WHEREAS, a robust partnership has been working collaboratively to advance the Master Plan, including Russell County, The Dante Community Association, Virginia Tech Community Design Assistance Center, Appalachian Voices, Southwest Virginia Workforce Development Board, Spearhead Trails, The Nature Conservancy, People Incorporated, Appalachian Trail Conservation Corps, Dialogue + Design Associates, and others.

WHEREAS, in line with the vision set forth in the Master Plan, the Steam Building redevelopment project is intended to rehabilitate the building to serve as a virtual training and co-working center, to be staffed and operated by the Southwest Virginia Workforce Development Board. This will provide a valuable service to the residents of Dante and the surrounding community and will help to connect Russell County residents to training and employment opportunities.

WHEREAS, Russell County has successfully secured a Department of Housing and Community Development Industrial Revitalization Fund (DHCD IRF) technical assistance grant for the sum of $50,000 to perform preliminary architectural and engineering design, as well as to conduct an economic impact analysis. “The general registrar shail report to the Department for each precinct in his locality the number and results of absentee ballots cast by voters assigned to such precinct. Results from absentee voting and voting at the precinct on election day shall be reported separately. The general registrar shall also report to the Department of Elections the number and results of absentee ballots cast early in person pursuant to § 24.2-701.1 separately from the number and results of all other absentee ballots…”

To comply with the new legislation, as voters check in, a ballot will print for that voter that is specific to the precinct they are registered to vote in. The printers, provided by DemTech, are compatible with Russell’s ePollTAB laptops, also provided by DemTech.

Board Action Requests

VDOT is not seeking any Board action this month.

Maintenance Activities

Maintenance crews are actively involved in a variety of activities with a heavy emphasis on mowing, including: « Allprimary routes have been mowed and over 90% of the secondary routes in the County have been mowed.

© Brush cutting was completed on segment(s) of Routes 65, 614, 628, 636, 640, 711, 770 and 794,

«Pothole patching operations continued with patching completed on Routes 63, 80, 611, 636, 645 and 646.

Maintenance work (spreading gravel, blading) was conducted on routes 655, 669, 693 and 746. «Ditching was completed on portions of Routes 58, 657 and 858.

  • Shoulder repairs were completed on Route 646,

  • Down trees were removed from Routes 19, 603, 656 and 673.

Maintenance Activities Planned

  • Culvert replacement and associated ditching on Routes 67 and 600,
  • Slope stabilization on Routes 600 and 712
  • Culvert replacement & associated ditching on Route 730 (Requires permit)
  • Ditching on Routes 740 and 645

  • Sinkhole repair on Route 19 ‘+ _ Installation of sand barrels between guardrail and signal pole at the WalMart entrance Route 19 intersection, once a hired equipment contract in place.

Roadside mowing operations will continue through the mowing season.

Pothole patching will continue as weather and other workload requirements allow.

Rural Rustic / 6 Year Plan Proiects

Tumbez Hollow & Thomas Warner Rural Rustic Projects

Paving has been completed on both projects; shoulder stone is anticipated to be placed later in the summer.

Future 6 Year Plan Projects

Blanch Davis Road (Route 606) is the next project on the 6 year plan list and receives approximately 40% of its funding in July. The residency plans to complete drain pipe installation and other work this fall with paving to be completed following receipt of balance of funding in July 2023, Plans have been completed and moving through the environmental review process.

North Cedar Acres is a small project (adding approximately 370 feet) of road utilizing residual funding from previously completed projects and is proposed for completion this summer fall.

Pure Salmon Proiect

No new information to report this month, a recent site visit indicated progress continues on the construction of the connection to Route 19. The residency understands utility relocation will be required before the final blasting / excavation can be completed to make the connection to Route

ATTORNEY’S REPORT Project “Trout” has been paid in full and closed out.

Project “Whale” has asked for two dates to finalize the agreement on the property. The Executive Director and the attorney will coordinate a date with the project.

EXECUTIVE DIRECTOR’S REPORT Congressman Griffith wants to have a ribbon cutting on June 1, 2022 at the MOSS III industrial site.

Project “Trout” now being closed, the IDA needs to release the VCEDA funds appropriated for the project.

Upon motion made by Roger Sword, second by John Stamper, and duly approved by The Industrial Development Authority of Russell County, Virginia, authorizing the Executive Director to submit a letter to VCEDA releasing the funds obligated to Project “Trout”. The Executive Director. Chairman and Secretary are authorized to sign all documents pertaining to this motion.

The Christian Center wants to lease one of the back offices in the Government Center, A lease has been prepared and needs to be approved by the board.

TRANSFER STATION STAFFING: Motion was made by Tim Lovelace and seconded by Damon Rasnick to enter closed meeting pursuant to Section 2.2-371 1(A)(1) of the Code of Virginia to discuss personne! matters and that Toby Edwards, Saundra Honaker, and Phillip Justice attend, as they are deemed necessary and would aid the Board in their consideration. A motion was made by Ron Peters and seconded by ‘Tim Lovelace to accept the bid of $13,805 from Bostic Sealing and Striping, Inc. with the stipulation that an insurance certificate and contractor’s license be presented prior to commencing the work and that the work not commence until after July 1, 2022. The approximate cost would be around $18,000.
